These Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of goods, or services, including limitations of liability.These Terms and Conditions constitute a contract between the customer (You) and 555 Systems Pty Ltd.

In these Terms and Conditions We, Our or Us means 555 Systems Pty Ltd; and You or Your means the person who accepts these Terms and Conditions, by using this Website and associated software, networks and processes, including the purchase of Products, or Services through the Website.

By browsing the Website, or placing an Order, You agree to these Terms and Conditions as set out below, which constitutes a legally binding Agreement between Us and You for the supply of Products, or Services.

The Agreement together with Your Order constitute the entire agreement between Us and You for the supply of Products, or Services. The Agreement cannot be varied unless We agree to vary it in writing or by email.

2. Legal Capacity
If you are under the age of eighteen (18) years you cannot place Orders with 555 Systems Pty Ltd on the 555 Shopper Website. By accepting this Agreement, You acknowledge that You are over the age of eighteen (18) years.

4. Pricing

Prices displayed on the Website are subject to change without notice. Once an Order has been accepted by Us and a Purchase Contract formed under clause 6, the price of the Product cannot be varied except:

a. by agreement between You and Us in writing or by email; or

in accordance with clause 7.4.

All prices listed on the Website exclude Delivery Costs. Delivery Costs are shown separately on an Order.

5. Product Specification

Features and specifications of Products described or depicted on the Website are subject to change without notice. For the avoidance of doubt, We will not materially change the features and specifications of a Product once an Order has been accepted by Us and a Purchase Contract formed under clause 6.

All weights and dimensions of Products described in the Website are approximate. All screens are measured diagonally and all screen images contained on the Website are simulated unless otherwise indicated.

6. Orders

6.1
You may place an Order by following the instructions on the Website. By placing an Order, you make offer to enter into an agreement to purchase the Products, or Services the subject of Your Order (Purchase Contract).

6.2
Orders will be deemed to have been received by 555 Shopper Website at the time our system sends an Order confirmation to Your nominated e-mail address.

6.3
The 555 Shopper Website is an online business and will primarily communicate with Customers via e-mail. It is the Customer’s responsibility to ensure the correct contact details are entered and that the nominated e-mail address is regularly checked for correspondence.

555 Systems Pty Ltd reserves the right to decline to enter into a Purchase Contract with You and may cancel Your 555 Shopper Order at any time prior to dispatch of the Products, or Services.

6.5
In the event of a cancelled Order not dispatched, funds paid in relation to that Order will be refunded in full. You will be provided with e-mail confirmation of the cancellation and refund.

555 Systems Pty Ltd does not accept any responsibility for Orders that are declined, delayed or not accepted due to disruptions with internet connections.

6.7
555 Systems Pty Ltd shall not be liable for any delay in performing any of its obligations under this Agreement if such delay is caused by circumstances beyond the reasonable control of Us (or any of Our affiliates), and 555 Systems Pty Ltd shall be entitled to a reasonable extension of time for the performance of such obligations.

6.8
Where You have provided an incorrect or incomplete delivery address for Your Order, We may charge a redelivery fee for each subsequent delivery attempt.

7. Payment

7.1
At the Checkout You may choose to pay with your Credit or Debit card via the PayPal website, or just use your Paypal account if you have one. You also can choose to pay for the Products, or Services with Cryptocurrencies via Coinbase.

7.2
555 Systems Pty Ltd shall not be liable for any refusal or delay in the payment process.

7.3
555 Systems Pty Ltd has no control over how they processing the payment, PayPal and Coinbase are separate payment processing companies with their own Terms & Conditions. Customers ordering on the 555 Shopper Platform should read and accept the Terms & Conditions of PayPal, or Coinbase.

7.4
Payment for Orders will be processed immediately upon confirmation of Your Order.

7.5
Your order will be processed immediately after the payment confirmation.

8. Deliveries

8.1
We try to ensure that all Products, or Services are delivered in a prompt and timely manner. However, from time to time, it is possible that shipping and other factors outside of Our control may result in delays. 555 Systems Pty Ltd does not accept any liability for loss or damage suffered by anyone as a result of any such delays.

8.2
The date of dispatch listed on the Website is the estimated date of dispatch as is reasonably estimated by 555 Systems Pty Ltd. Where scheduled dispatch of a Products, or Services is delayed by more than one week, Customers will be notified by e-mail via the e- mail address nominated in their Order. Customers are permitted to cancel their Order and receive a refund or store credit at any time prior to dispatch of the Products, or Services.

8.3
555 Systems Pty Ltd will not deliver Products to PO Box addresses.

8.4
Where a Customer gives written authority for Products to be delivered without a signature, any and all included insurance cover will be voided.

8.5
The couriers or postal services nominated by 555 Systems Pty Ltd will deliver Products during local business hours (9am to 5pm, Monday to Friday).

8.6
555 Systems Pty Ltd is not responsible for the delivery times of Products. Once Products have been dispatched, it is the Customers responsibility to liaise with the courier nominated by 555 Systems Pty Ltd (as notified to the Customer) in relation to date and time of delivery. 555 Systems Pty Ltd shall not be liable for any inaccuracy of information provided to Customers relating to the date and time of delivery.

8.6
555 Systems Pty Ltd reserves the right to not ship to remote or rural locations.

9. Faulty and damaged Goods

555 Systems Pty Ltd will organise repair, replace or refund faulty or damaged Products in accordance with the Your rights under the Australian Consumer Law.

9.1
Your Rights under the Australian Consumer Law

When purchasing goods and services from a business, consumers are provided with automatic guarantees and rights under the Australian Consumer Law (ACL).

The ACL states that goods must match any descriptions provided, be safe, lasting, and with no faults, and function as they are meant to. 555 Systems Pty Ltd provides Products, or Services outlined by the Consumer Guarantees that cannot be excluded under the Australian Consumer Law. These Guarantees mean that you are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer Guarantees generally apply for an amount of time that can be considered reasonable given factors such as the type and cost of the product or any representations made regarding the good’s longevity.

Manufacturer Support – Faulty Products and Consumer Guarantees

In most instances, where you experience an issue with a product that comes with a manufacturer’s warranty, the manufacturer will be able to provide a faster assessment and remedy than us. Many manufacturers will have dedicated support centres with access to more detailed knowledge on their respective products, in addition to better access to spare parts.
You may prefer to contact the manufacturer directly to seek a resolution rather than 555 Systems Pty Ltd.

If you would prefer Us to assist you, and choose not to go to the manufacturer, then our team will of course be happy to assist you.

9.3
If a product has become faulty, or is no longer of acceptable quality as outlined in the ACL, please contact 555 Systems Pty Ltd via the 555 Shopper, Contact Us page or send an email to info@555shopper.com.au email address. You will need to provide proof of purchase in the form of an order reference, a copy of your invoice, or by contacting us using the email address that was used to complete the order. 555 Systems Pty Ltd may request further evidence of the reported fault in the form of photos or video and may provide some simple troubleshooting steps prior to proceeding with a claim. This information is important in order to confirm that the item is faulty and that this was not the result of misuse or accidental damage. 555 Systems Pty Ltd reserves the right to have returned goods assessed at a nominated repair centre within a reasonable timeframe to determine the nature of any issues and whether or not the goods are faulty or otherwise not as described.

You are required to return any accessories that were originally provided along with the product. This can include power adapters, charging adapters and cables. Where possible, we recommend that you retain the original packaging to ensure safe transit of your product to return. Should a replacement or refund be provided, it is a requirement that you have made your best effort to return all included accessories provided with the purchase. 555 Systems Pty Ltd reserves the right to not provide a remedy where the fault in the goods was caused by an accident that occurred after the unit was delivered or is due to misuse or incorrect/unauthorised installation, an unauthorised modification (hardware or software), where the goods have been misused or used other than for their disclosed purpose. Our Warranty Policy does not apply to general wear and tear and normal ageing of the product.

10. Returns

13. Gift Vouchers

Gift Vouchers have a validity of 12 months from the date of purchase, unless otherwise specified at the time of issue in writing.

14. Miscellaneous

For the avoidance of doubt, any such changes will operate prospectively from the time that the revised Terms and Conditions are published on the website and will not impact any Purchase Contracts entered into prior to the date of the publication of the revised Terms and Conditions.

Any provision of these Terms and Conditions which is void or unenforceable may be severed from these Terms and Conditions without affecting the enforceability of other provisions.

A failure or delay by 555 Systems Pty Ltd Ltd to exercise a power or right under these Terms and Conditions does not operate as a waiver of that power or right, and the exercise of a power or right by 555 Systems Pty Ltd does not preclude its future ability to exercise that or any other power or right.

Insofar as they apply to the ordering, purchase, fulfilment and delivery of 555 Systems Pty Ltd Ltd Products from 555 Shopper Website the Terms and Conditions and General Terms and Conditions are governed by and must be construed according to the law of the State of NSW, Australia and the parties submit to the jurisdiction of the courts in that State.
